These terms set out the basis on which Emergency Roadside Assistance (“we”, “us”) provides mobile tyre fitting, puncture repair and vehicle recovery across the UK. By asking us to attend a job you agree to these terms. Nothing in them takes away rights you have under UK law.

Who we are and how these terms apply

Emergency Roadside Assistance is a UK mobile tyre fitting, puncture repair and 24/7 car towing and recovery service. Our full business details are on our Contact page. You can call us on 07882 507772 or message us on WhatsApp. These terms apply to every job we carry out, whether you book by phone, WhatsApp or through this website. If we agree anything different with you in writing, that agreement takes priority over these terms for that job.

Booking and quotes

When you contact us we will ask for your location, your vehicle details and what has gone wrong. We will then give you a fixed price for the job, including any call-out charge, before we send a fitter or recovery truck. The price we agree is the price you pay, unless the job turns out to be different from what you described (for example, two tyres need replacing rather than one). If that happens we will explain the change and agree a new price with you before doing any extra work.

Any arrival time we give is our best estimate. Traffic, weather and other emergencies can cause delays, and we will keep you updated if we are running late.

We may decline or stop a job if we believe it is unsafe, for example because of the vehicle’s position or condition, or the behaviour of anyone at the scene. If we have already been dispatched, a reasonable call-out charge may apply.

Mobile tyre fitting

Tyres we supply

Tyres we supply are new, unless we tell you otherwise, and come with the manufacturer’s warranty against defects. The price includes fitting, a new valve where needed, balancing and disposal of the old tyre. We fit the size and speed rating you give us or that we read from your vehicle, so please check the details are correct before we fit.

Puncture repairs

We repair punctures only where it is safe to do so under British Standard BS AU 159. This means the damage must be in the central repairable area of the tread and the tyre must not have been run flat or damaged inside. If a tyre cannot be repaired safely we will tell you why and offer a replacement. We will not repair a tyre that fails the standard, even if you ask us to.

Tyres you supply

We can fit tyres you have bought elsewhere at a fitting-only price. We will inspect them before fitting and may refuse to fit a tyre that is damaged, worn, the wrong size or unsuitable for your vehicle. We are not responsible for any defect in a tyre you have supplied.

Old tyres

We take away your old tyres and dispose of them through a licensed waste carrier. If you would like to keep an old tyre, tell the fitter before work begins.

Recovery and transport

Before we load your vehicle, our driver will note its condition and may take photographs. This record is used if there is any later question about damage. Please remove valuables and personal items before loading. We are not responsible for loose items left in the vehicle unless they are lost or damaged through our negligence.

We will deliver your vehicle to the destination agreed when you booked. If the destination cannot accept the vehicle (for example, a garage is closed), we will contact you to agree an alternative. Any extra mileage will be charged at the rate quoted at the time.

If we have to hold your vehicle because no destination is available or because payment is outstanding, we will tell you where it is. After 24 hours a daily storage charge may apply. We will tell you the charge before it starts. Vehicles are released once the full balance has been paid.

Payment

We accept card, bank transfer and cash. Payment is due in full when the job is completed, unless we have agreed an account with you in writing. For account customers, invoices are payable within the period shown on the invoice.

If an invoice is not paid on time we may charge interest at 4% a year above the Bank of England base rate from the due date until payment is made, and recover the reasonable costs of collecting the debt. Business customers may instead be charged statutory interest under the Late Payment of Commercial Debts (Interest) Act 1998.

Cancellations and no-shows

You can cancel a booking free of charge at any time before a fitter or recovery truck has been dispatched. Once we are on our way, or if we arrive and you are not there or cannot be reached within 20 minutes, we may charge a reasonable call-out fee to cover our time, fuel and any tyre we have brought specifically for you. We will tell you the call-out fee when you book.

Our liability

We hold public liability and motor trade insurance and we carry out every job with reasonable care and skill. If we damage your vehicle or property through our fault, we will put it right or pay for the repair.

Unless the law says otherwise, our total liability for any job is limited to the price you paid for that job. We are not liable for losses that were not a foreseeable result of our breach, for loss of earnings or business, or for faults that were already present in your vehicle before we attended, such as worn suspension parts, damaged wheels or tracking problems.

Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be limited.

Your responsibilities

Your consumer rights

If you are a consumer, nothing in these terms affects your statutory rights under the Consumer Rights Act 2015. This includes the right to have services carried out with reasonable care and skill, and the right to goods that are of satisfactory quality, fit for purpose and as described. If we get something wrong you can ask us to repeat or fix the work, or to reduce the price.

Where you book by phone, online or by message, you normally have 14 days to cancel without charge. Because our service is usually needed straight away, by asking us to attend immediately you request that we start work within the 14-day period and you agree that your right to cancel ends once the job has been fully carried out. If you cancel after we have started but before we finish, you pay only for the work done up to that point.

Complaints

If something has gone wrong, please tell us as soon as you can by calling 07882 507772. We will acknowledge your complaint within two working days and aim to resolve it within 14 days. If we cannot agree a solution, you may use an alternative dispute resolution service or take the matter to court.

Changes to these terms

We may update these terms from time to time. The version on this page when you book applies to your job. The date at the top shows when the terms were last revised.

Governing law

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction over any dispute. If you live in Scotland or Northern Ireland you may also bring proceedings in your local courts.
